terms & conditions
Effective April 19, 2026
1. Acceptance of Terms
By accessing and using shelbicox.com (the "Site"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Site.
If you have entered into a separate written service agreement, statement of work, or product license with Shelbi Cox, the terms of that agreement control and supersede these Terms to the extent of any conflict.
1a. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase products or enter into any agreement through this Site. By using the Site or placing an order, you represent that you meet this requirement.
1b. Electronic Communications
By using the Site, submitting the contact form, or placing an order, you consent to receive communications from me electronically (by email or via Etsy messaging). You agree that any notices, disclosures, or other communications provided electronically satisfy any legal requirement that such communications be in writing.
2. Use of the Site
This Site is a personal portfolio and informational website operated by Shelbi Cox. You may browse the Site for personal, non-commercial purposes. You agree not to:
- Copy, reproduce, or redistribute any content without prior written permission
- Use the Site for any unlawful purpose
- Attempt to interfere with the Site's operation or security
- Scrape, crawl, or use automated tools to extract data from the Site
3. Intellectual Property
All content on this Site and across Shelbi Cox's linked properties — including but not limited to artwork, illustrations, digital prints, photographs, written content, website design and layout, logos, branding, app designs, and any other original works — is the sole intellectual property of Shelbi Cox and is protected under applicable copyright and intellectual property laws.
You may not, without express prior written permission from Shelbi Cox:
- Copy, reproduce, download, or save any artwork, images, or designs from this Site or linked storefronts
- Reproduce, print, or manufacture any product based on or derived from original artwork or designs
- Use any content for commercial purposes, including resale, licensing, or promotional materials
- Modify, adapt, create derivative works from, or alter any original content in any form
- Claim ownership of or remove attribution from any original work
- Use screenshots, screen recordings, or other captures of this Site's design, layout, or content without permission
Purchasing a product (physical or digital) grants you a personal-use license for that item only. It does not transfer intellectual property rights, nor does it grant permission to reproduce, resell, or commercially distribute the work in any form.
4. Orders, Products & Fulfillment
All product orders — including art prints, mugs, stickers, and other physical goods — are processed through the Etsy storefront. Physical items are manufactured and fulfilled through Printful, a third-party print-on-demand service.
Digital products (such as digital downloads and the guided journal) are also sold and delivered through Etsy.
By placing an order, you agree to the terms and policies of both Etsy and Printful, which govern payment processing, shipping, and returns for physical goods. Shelbi Cox is not responsible for shipping delays, printing errors, or fulfillment issues handled by Printful — though I will always do my best to help resolve any problems.
5. Returns, Refunds & Exchanges
Because physical products are made to order through Printful, returns and exchanges are handled on a case-by-case basis. If your item arrives damaged or defective, please reach out within 14 days of delivery and I will work with you and Printful to resolve it.
Digital products are non-refundable once downloaded, due to the nature of digital goods.
For any order issues, please contact me via the contact form or through Etsy messaging.
6. Digital Products & Personal Use License
Digital downloads (e.g., the guided journal for moms, digital prints) are licensed for personal, non-commercial use only. You may not:
- Resell, redistribute, or share purchased digital files
- Use digital products for commercial purposes or in products for sale
- Upload digital products to any file-sharing or print-on-demand platform
- Claim authorship or remove watermarks, credits, or attribution
Delivery & ongoing access. Digital downloads are delivered through Etsy at the time of purchase. It is the buyer's responsibility to download, save, and back up digital files promptly after purchase and to keep a personal copy. I do not guarantee indefinite redelivery, re-hosting, or continuous access to digital files once the initial download has been made available. If a file link is temporarily unavailable or corrupted, please reach out and I will do my best to resend — but I am not liable for lost files, expired links, or access issues caused by Etsy, your device, your internet service, or cloud storage providers.
Right to revoke access. I reserve the right to revoke access to any digital product, refuse future sales, or cancel an order — with or without refund — in cases of suspected fraud, chargeback abuse, violation of the license terms above, harassment, or any other misuse of the product or Site.
Updates & maintenance. I may, at my sole discretion, update, revise, or discontinue any digital product at any time. I am under no obligation to provide updates, revisions, or ongoing maintenance to previously purchased digital files.
6a. Website Build Offerings
This Site links to four website-related offerings — the DIY Website Build Guide, Guided Build, Done-for-You Build, and the All-in-One Monthly plan — which are sold and delivered under Zanalytics Consulting. Detailed terms for each offering (including scope, deliverables, timelines, and client responsibilities) live on the Zanalytics Consulting site and are the controlling terms for those purchases. Buyers are expected to review those terms at checkout. The summary below covers only what's needed to set expectations and liability here.
DIY Website Build Guide. The Guide is a digital product purchased through Stripe and delivered via a Dropbox link immediately after checkout. You are responsible for downloading and saving your own copy promptly — continued access to the original Dropbox link is not guaranteed. The Guide is licensed for your personal or business use only; you may not resell, redistribute, publicly post, or share the Guide outside your household or immediate team. I reserve the right to revoke access, without refund, if the Guide is shared or used in violation of these Terms or if a payment is reversed or charged back.
Guided Build, Done-for-You Build, and related consulting services. Each engagement is governed by a separate written proposal, SOW, or email-confirmed scope that specifies deliverables, timeline, and fees, and that separate agreement supersedes these Terms. A deposit may be required before work begins. Client responsibilities include timely feedback, content, and access, and securing rights for any content (logos, images, copy, data) you provide.
All-in-One Monthly plan. This is a recurring subscription billed at the then-current price (currently $97/month) through Stripe. It includes an initial website build plus ongoing hosting, maintenance, and small updates on a best-effort basis; larger changes are scoped separately. There is a four-month minimum commitment, and the subscription renews automatically each month until canceled. You authorize Zanalytics Consulting (via Stripe) to charge your payment method on a recurring basis. To cancel after the minimum, email 30 days' written notice; cancellation takes effect at the end of the final paid period, and you are responsible for arranging new hosting after that. Cancellations during the four-month minimum do not release you from the remaining payments unless otherwise agreed in writing. Prices may change on notice by email.
No guarantee of outcome. The Guide and all website services are provided for informational, educational, and professional purposes. I bring care and experience to every engagement but do not guarantee specific traffic, revenue, conversions, launch timelines, or business outcomes. The Guide references third-party tools (Claude Code, Netlify, VS Code, Dropbox, Stripe, and others) that I am not affiliated with, endorsed by, or responsible for; their availability, pricing, and functionality may change at any time.
Release of liability for builds and the Guide. To the fullest extent permitted by law, Shelbi Cox and Zanalytics Consulting are not liable for damages, losses, or issues arising from your use of the Guide or any website service, including technical issues, hosting problems, domain configuration, data loss, downtime, or costs incurred through third-party services. My total liability for any claim related to a specific product or engagement is limited to the amount you actually paid for that product or engagement.
7. Third-Party Links & Services
This Site contains links to third-party websites and platforms, including Etsy, Printful, LinkedIn, Substack, and external project sites. These links are provided for convenience. Shelbi Cox is not responsible for the content, privacy practices, terms, or availability of any third-party sites or services.
8. User-Generated Content & Communications
The Site provides a contact form for inquiries. By submitting a message, you consent to your information being used solely to respond to your inquiry. Submissions are processed through Netlify Forms. You agree not to submit content that is unlawful, harassing, defamatory, or infringing on the rights of others.
8a. AI Tools
I may use AI-assisted tools (such as large language models) to support my own workflow — for example, drafting copy, organizing notes, brainstorming, or generating portions of the Site's code. Some products or content on the Site may be created with the help of such tools. I review output before publishing or delivering it, but AI-assisted content may still contain errors or inaccuracies and is provided on an "as is" basis. I do not feed your personal information, contact form submissions, or order data into third-party AI systems for training.
9. Disclaimer of Warranties & Release of Liability
This Site and all products, downloads, and content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Shelbi Cox makes no guarantees regarding the accuracy, completeness, reliability, or availability of any content on the Site, nor the quality, timeliness, or delivery of third-party fulfillment services.
To the maximum extent permitted by law, by using the Site or purchasing a product, you release and discharge Shelbi Cox from any and all claims, demands, and damages (actual and consequential) of every kind and nature arising out of or connected with your use of the Site, any digital or physical product, or any content obtained through the Site.
10. Limitation of Liability
To the fullest extent permitted by law, Shelbi Cox shall not be liable for any damages arising from your use of or inability to use the Site or its products, including but not limited to direct, indirect, incidental, consequential, special, or punitive damages. This includes, without limitation, issues arising from third-party services such as Etsy, Printful, Netlify, or payment processors; lost digital files; delivery delays; or any interruption, loss, or corruption of data.
11. Indemnification
You agree to indemnify and hold harmless Shelbi Cox from any claims, losses, or damages (including legal fees) arising from your violation of these Terms, misuse of the Site, or infringement of any intellectual property rights.
11a. Chargebacks & Payment Disputes
If you have a concern about an order, please contact me first through the contact form or Etsy messaging so I can try to resolve it directly. Initiating a chargeback or payment dispute without first attempting to resolve the issue — or after receiving a refund, replacement, or digital download — is considered a breach of these Terms. I reserve the right to dispute improper chargebacks with documentation, revoke access to any related digital products, and refuse future orders.
11b. Force Majeure
Shelbi Cox is not liable for any failure or delay in performance caused by events beyond reasonable control, including but not limited to acts of God, natural disasters, illness, power or internet outages, hosting or platform outages (including Etsy, Printful, or Netlify), labor disputes, shipping carrier delays, governmental actions, or cyberattacks.
12. Changes to These Terms
These Terms may be updated from time to time. Continued use of the Site after changes constitutes acceptance of the revised Terms. The effective date at the top of this page reflects the most recent update.
13. Accessibility
Shelbi Cox is committed to ensuring that this Site is accessible to all visitors, including people with disabilities. I strive to meet or exceed the requirements of the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA.
This Site incorporates the following accessibility practices:
- Semantic HTML: Proper heading hierarchy, landmark elements, and semantic markup to support assistive technologies such as screen readers
- Keyboard navigation: All interactive elements are accessible via keyboard
- Color contrast: Text and interactive elements meet WCAG AA contrast ratio requirements
- Readable typography: Fonts are sized for readability with relative units to support browser-level text scaling
- Alt text: Images include descriptive alternative text where applicable
- Focus indicators: Interactive elements have visible focus states for keyboard-only users
- Responsive design: Usable across a range of devices and screen sizes
- Reduced motion: Animations are minimal and non-essential
This Site aims to conform to WCAG 2.1 Level AA, Section 508, and ADA Title III requirements. If you experience any difficulty accessing content, please reach out via the contact form. I aim to respond to accessibility feedback within 5 business days.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the appropriate courts.
15. General Provisions
- Entire agreement: These Terms, together with the Privacy Policy and any separate written agreement you have entered into with Shelbi Cox, constitute the entire agreement between you and Shelbi Cox concerning your use of the Site and any products purchased through it, and supersede all prior or contemporaneous communications and proposals on the subject.
- Severability: If any provision of these Terms is found unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
- No waiver: My failure to enforce any right or provision of these Terms is not a waiver of that right or provision. Any waiver must be in writing to be effective.
- No assignment: You may not assign or transfer these Terms, or any rights or obligations under them, without my prior written consent. I may assign these Terms at my discretion.
- Right to decline or end service: I reserve the right, at my sole discretion, to decline any order, refuse service, cancel accounts, or terminate access to the Site or any product at any time and for any reason, including suspected misuse, violation of these Terms, or conduct I consider harmful or inappropriate.
- Separate service agreements control: If a separate written service agreement, license, or statement of work applies, the terms of that agreement supersede these Terms to the extent of any conflict.
16. Contact
If you have questions about these Terms, please reach out via the contact form on the Site.
